Request
I am requesting the following information held by your constabulary for the periods:
Please provide a breakdown of the data for each council area or policing district within your constabulary’s jurisdiction, where applicable.
For each council area/district, please provide:
1. Speeding offences – The total number of speeding tickets or fines issued during each period, along with the month in each period that recorded the highest number of offences.
Clarification sought:
Do you wish to know the number of individuals stopped by an officer and issued with a conditional offer of £100 and 3 points, or individuals stopped by an officer and issued a fine at court or both?
Clarification Received:
If we can get the total number for both please categorised accordingly if it (a) falls under a conditional offer and (b) issued a fine.
2. Drink driving offences – The total number of recorded drink driving offences during each period, along with the month in each period that recorded the highest number of offences.

Are you referring to incidents or crimes?
Incident and crime definition/differences:
Please note an incident is different from a crime. An incident is a record of contact made to a police force by an individual/member of public (usually via a 999 or 101 call) and a crime is where the threshold has been met for the police force to deem that a criminal offence has occurred as defined by law.

Can we also get the total number for both (a) incident and (b) crime
3. Car theft incidents – The total number of reported car theft incidents during each period, along with the month in each period that recorded the highest number of incidents.
4. Causes of car accidents – The leading cause of car accidents during each period, along with the month in each period in which this leading cause resulted in the highest number of accidents

With regards to Q4, Are you happy to receive a time estimate for all RTC reports submitted by an officer only? –

5. Seatbelt-related fatalities – The total number of fatalities caused by not wearing a seatbelt during each period, along with the month in each period that recorded the highest number of such fatalities.

With regards to Q5, would you like figures of all fatal cases where it is believed that the deceased was not wearing a seatbelt at the time of the collision.

6. Dropped kerb offences – The total number of enforcement actions (tickets, fines or penalty charge notices) issued for vehicles obstructing or parking on a dropped kerb during each period, along with the month in each period that recorded the highest number of such offences.

With regards to Q6, Can you also be more specific about the offence that you require data for. The closest offence that we can find is causing an unnecessary obstruction. Are you happy to receive information for this offence code?

If we can get the data broken down to tickets, fines or penalty charge notices please but if not, "unnecessary obstruction" is fine too.
Response Q1
Section 1 of the Freedom of Information Act 2000 places two duties on public authorities. Unless exemptions apply, the first duty at Section 1(1) (a) is to confirm or deny whether the information specified in a request is held. The second duty at Section 1(1) (b) is to disclose information that has been confirmed as being held.
Where exemptions are relied upon Section 17 of the Freedom of Information Act 2000 requires Dyfed Powys Police, when refusing to provide such information (because the information is exempt) to provide you the applicant with a notice which: (a) states that fact, (b) specifies the exemption in question and (c) states (if that would not otherwise be apparent) why the exemption applies.
I can confirm that Dyfed-Powys Police does hold the information you have requested. However, we are withholding the whole of the requested information since we consider that the Section 12(1) exemption the Cost of Compliance exceeds the Appropriate Limit applies to it.
Section 12 (1) – The cost of compliance exceeds the Appropriate Limit
Section 12(1) states: “…Section 1 (1) does not oblige a public authority to comply with a request for information if the authority estimates that the cost of complying with the request would exceed the appropriate limit.”
The cost of providing you with the information requested in respect of your request is above the amount to which we are legally required to respond i.e. the cost of locating and retrieving the information exceeds the “appropriate level” as stated in the Freedom of Information (Fees and Appropriate Limit) Regulations 2004. It is estimated that it would exceed 18 hours (i.e. minimum of 1,749 hours) to comply with this part of your request. The regulations can be located @ https://www.legislation.gov.uk/uksi/2004/3244
The Freedom of Information department has been advised that the information in respect of Question 1(Part of), Q4, Q5 & Q6(Part of) of your request is not held in an easily retrievable format. In light of this and in order to accurately obtain the information relative to your request for the time frame stipulated would involve Dyfed Powys Police accessing and manually reviewing a total of 17,615 records, of which it has been established that it would take a minimum of 5 minutes to review 14,238 of these records, and a minimum of 10 minutes to review a further 3,377 records, in order to obtain the information for a single record in respect of your request.

It is very difficult for us to say if the person died as a result of not wearing a seatbelt as this information often does not come to light until an inquest is held into each case.
The below time estimate in order to access and manually review fatal file records.
2024 – 30 files x 10 minutes
Up to 28th August 2025 – 17 files x 10 minutes
TOTAL = 7.8 hours
Q6
The below time estimate in order to establish data regarding the number of individuals stopped by an officer and fined at court then I would have to review every case file to obtain this information which would be a time estimate.
2024 – 4,422 files x 5 minutes
Up to 28th August 2025 – 2697 files x 5 minutes
TOTAL = 593.2 hours
In accordance therefore with the Freedom of Information Act 2000, this letter acts as a Refusal Notice for the Whole of this request under Section 17(5) A public authority which, in relation to any request for information, is relying on a claim that section 12 or section 14 applies must, within the time for complying with section 1(1), give the applicant a notice stating that fact.
You may wish to refine and resubmit your request so that it reduces the time shown above to fall within the 18 hours, should you require any further advice in relation to this matter please don’t hesitate to contact the Freedom of Information Unit. Please also be advised that should the request be refined, it does not remove the public authorities right to cite exemptions if relevant.
Although excess cost removes the forces obligations under the Freedom of Information Act to provide any further information, as a gesture of goodwill, I have provided information, relative to question 1 & part of question 6 of your request which has been easily retrievable and outlined below. I trust this is helpful, but it does not affect our legal right to rely on the fees regulations for the remainder of your request.

In relation to question 2 we do not hold this specific data on old systems as it is a non-notifiable offence.
Q2
There is data retrievable directly from our system for the volumes of ‘Drive whilst unfit through drink recordable’ or ‘Drive motor vehicle when alcohol level above limit recordable’.
We can also provide the volume the occurrence type `Drink Driving’. It is important to note these may not include all incidents / crimes and is not an offence category, rather an occurrence type category (may be associated with other offences than listed).
Q3
We can provide theft of a vehicle offence volumes within 18 hours.
However, if requesting car theft incidents, we would have to manually review all `C-Theft’ records to identify whether they relate to Car theft incidents
It should be noted that as a result of the systems adopted by Dyfed-Powys Police in relation to the recording of such information that the information released may or may not be accurate.
