Request:

I am writing to request recorded information held by Dyfed-Powys Police concerning anti-social behaviour, non-crime hate incidents, protest/public order policing, and neighbourhood policing resourcing.

Before making this request, I have reviewed the published disclosure material available on the Dyfed-Powys Police website relating to anti-social behaviour, including the published ASB search results, ASB policy material, force-wide ASB disclosures, response-time disclosures, and ASB powers disclosures.

This request is therefore intended as a gap request. I am not asking Dyfed-Powys Police to re-send information that is already published. I am asking for local aggregate information relating specifically to Carmarthenshire related information which does not appear to be fully answered by the existing published disclosures.

Please provide the following information for Carmarthenshire only, for each of the calendar years 2022, 2023, 2024, 2025, and 2026 to date. If the information is held by financial year rather than calendar year, please provide it by financial year instead.

1. Anti-social behaviour in Carmarthenshire

Please provide, for each year:

The total number of anti-social behaviour incidents recorded in Carmarthenshire.
A breakdown of those incidents by the ASB categories used by Dyfed-Powys Police, for example personal, nuisance, environmental, or any other category used by the force.
If held electronically and retrievable without manual review of individual records, the number of ASB incidents in Carmarthenshire by outcome category, including:

i. no further action;
ii. advice or words of advice;
iii. community resolution;
iv. warning, acceptable behaviour contract, civil order, injunction, dispersal power, or other formal ASB power;
v. arrest;
vi. charge or summons;
vii. any other outcome category used by the force.

For the avoidance of doubt, I am not requesting incident logs, names, addresses, free-text narratives, private locations, or information identifying individual victims, witnesses, suspects, complainants, or households.

2. Hate crimes, hate incidents, and non-crime hate incidents in Carmarthenshire

Please provide, for each year:

The total number of hate crimes recorded in Carmarthenshire.
The total number of hate incidents recorded in Carmarthenshire which did not amount to recorded crimes.
The total number of non-crime hate incidents recorded in Carmarthenshire.
For each of the above, please provide a breakdown by recorded hostility or protected characteristic category, including race, religion, disability, sexual orientation, transgender identity, and any other category used by the force.
If held electronically and retrievable without manual review of individual records, the number of non-crime hate incidents in Carmarthenshire where personal data was recorded about an alleged subject, suspect, or person complained about.
If held electronically and retrievable without manual review of individual records, the number of non-crime hate incidents in Carmarthenshire where the alleged subject, suspect, or person complained about was contacted by police.

If answering parts 2(e) or 2(f) would require manual review of individual records, please state this clearly and provide only the rest of the information requested in section 2.

3. Non-crime hate incident policy and review

Please provide, or direct me to the exact published documents if already available:

The current Dyfed-Powys Police policy, procedure, officer guidance, or internal guidance on recording non-crime hate incidents.
Any previous versions of that policy, procedure, or guidance in force since 1 January 2020.
Any internal guidance, briefing note, training summary, or instruction issued to officers or staff since 1 January 2020 concerning:
i. the recording of non-crime hate incidents;
ii. the retention or deletion of non-crime hate incident records;
iii. the recording of personal data about people complained about;
iv. the balance between non-crime hate incident recording and Article 10 freedom of expression rights.
The review or retention period applied by Dyfed-Powys Police to non-crime hate incident records.
The process by which a person can request review, amendment, or deletion of a non-crime hate incident record relating to them.

4. Protest and public order policing in Carmarthenshire

Please provide, for each year:

The number of protests, demonstrations, public assemblies, marches, or other protest/public order events recorded or policed by Dyfed-Powys Police in Carmarthenshire.
The number of such events where police imposed conditions under the Public Order Act 1986 or other relevant legislation.
The number of such events where Section 60 or Section 60AA powers were authorised.
The number of arrests made in connection with protest or public order events in Carmarthenshire.
A breakdown of those arrests by broad offence category.
The number of those arrests resulting in:
i. no further action;
ii. caution;
iii. charge;
iv. summons;
v. community resolution;
vi. any other outcome category used by the force.
The number of complaints received by Dyfed-Powys Police about the policing of protests, demonstrations, marches, public assemblies, or public order events in Carmarthenshire, broken down by broad complaint category and outcome category where held.

5. Neighbourhood policing resources in Carmarthenshire

Please provide, for each year:

The number of police officers assigned to Carmarthenshire neighbourhood policing teams.
The number of PCSOs assigned to Carmarthenshire neighbourhood policing teams.
If held, the number of officers and PCSOs assigned to Llanelli, Carmarthen, Ammanford, and any other local policing areas within Carmarthenshire.

Format requested

Where possible, please provide numerical information in Excel or CSV format.

I am not requesting personal data, names, addresses, victim details, suspect details, complainant details, intelligence about named individuals, operationally sensitive tactics, or information that would compromise any live investigation. I would expect any such information to be redacted or withheld where necessary while aggregate statistical data, policies, guidance, and non-personal recorded information are disclosed.

If Dyfed-Powys Police does not hold some of the information broken down specifically for Carmarthenshire, please provide the closest available geographic breakdown and explain what geography has been used.

If any part of this request is likely to exceed the appropriate cost limit, please do not refuse the whole request outright. Instead, please provide advice and assistance under section 16 of the Freedom of Information Act 2000, and tell me which parts could be answered within the cost limit if the request were narrowed.

If necessary, please prioritise the request in the following order:

Carmarthenshire non-crime hate incident figures and policy/guidance;

Carmarthenshire neighbourhood policing resourcing.

Clarification:

To clarify Q1, I am referring to anti-social behaviour incidents, not recorded crimes.

For Q1(a) and Q1(b), I am asking for the number of records held by Dyfed-Powys Police where the incident was recorded or categorised as anti-social behaviour in the force’s incident recording / command and control system, for Carmarthenshire only, broken down by year and by ASB category where held.

I am not asking for a count of notifiable crimes, and I am not asking for incident logs, call transcripts, free-text narratives, or any personal data.

For Q1(c), I am asking whether those ASB incident records have any electronically held outcome, disposal, resolution, closure, or police-action category attached to them, such as no further action, advice given, community resolution, warning, use of ASB powers, arrest, charge/summons, or other force outcome category.

If the force does not hold those specific outcome categories for ASB incidents, or if the outcome/action data is not electronically retrievable without manually reviewing individual records, please state that and provide whichever electronically held disposal, resolution, closure, or action categories are used for ASB incidents instead.

So, in short:

For Q1(a) and Q1(b): ASB incidents, not crimes.

For Q1(c): electronically held outcome / disposal / closure / police-action categories for those ASB incidents, if held.

Response 3:

I can confirm that Dyfed-Powys Police does hold the information requested, as outlined below.

A. Section 1 of the Freedom of Information Act 2000 places two duties on public authorities. Unless exemptions apply, the first duty at Section 1(1)(a) is to confirm or deny whether the information specified in a request is held. The second duty at Section 1(1)(b) is to disclose information that has been confirmed as being held.

Where exemptions are relied upon Section 17 of the Freedom of Information Act 2000 requires -Powys Police, when refusing to provide such information (because the information is exempt) to provide you the applicant with a notice which:

(a) states that fact,

(b) specifies the exemption in question and

I can confirm that Dyfed-Powys Police does hold the information requested, however the following exemption has been applied to the whole of the information you have requested:

Section 21 – Information reasonably accessible by other means:

(1) Information which is reasonably accessible to the applicant otherwise than under section 1 is exempt information.

(2) For the purposes of subsection (1)—

(a)information may be reasonably accessible to the applicant even though it is accessible only on payment, and

(b) information is to be taken to be reasonably accessible to the applicant if it is information which the public authority or any other person is obliged by or under any enactment to communicate (otherwise than by making the information available for inspection) to members of the public on request, whether free of charge or on payment.

(3) For the purposes of subsection (1), information which is held by a public authority and does not fall within subsection (2)(b) is not to be regarded as reasonably accessible to the applicant merely because the information is available from the public authority itself on request, unless the information is made available in accordance with the authority’s publication scheme and any payment required is specified in, or determined in accordance with, the scheme.”

B. The relevant department has advised that no previous versions are held. Please note that the existing (2021) policy (link above) is currently under review and will be re-published later this year.

C. Guidance is routinely distributed via the bulletins system, but can also be in person, online or information via email.

This can be contributed to by various departments based on their interaction with hate crime such learning and development, criminal justice department and equality and diversity.

We do not have a central depository of all delivered advice, guidance and training.
