Request:
Under the Freedom of Information Act 2000, I am writing to request information from your constabulary relating to speeding offences recorded in 20mph and 30mph speed limit areas within your force area.
For the purposes of this request, I am referring to offences where a driver exceeded the posted speed limit on a public road in either a 20mph or 30mph limit.
I would be grateful if you could provide the following information.
Q1. The total number of speeding offences recorded in 20mph limits in each of the following calendar years: 2023, 2024 and 2025.
Q2. The total number of speeding offences recorded in 30mph limits in each of the following calendar years: 2023, 2024 and 2025.
Q3. The total number of speeding offences recorded in 20mph limits between 1 January 2026 and 31 March 2026.
Q4. The total number of speeding offences recorded in 30mph limits between 1 January 2026 and 31 March 2026.
Q5. Where held in a readily retrievable format, the highest recorded speed detected in a 20mph limit, and separately in a 30mph limit, during the period 1 January 2023 to 31 March 2026.
Q6. Where held in a readily retrievable format, the top three roads or locations within your force area with the highest number of speeding offences recorded in 20mph limits, and separately in 30mph limits, across the full period requested.
Q7. Where held in a readily retrievable format, the total number of offences in 20mph limits, and separately in 30mph limits, by outcome, including:
If any part of this request would exceed the cost limit under Section 12, please let me know how the request could be refined so that it can be completed within the limit.

Do you wish to know the number of individuals stopped by an officer and issued with a Traffic Offence Report for speeding or do you wish to know the number of individuals caught speeding via the speed camera vans and fixed cameras or both?

If Dyfed-Powys Police only holds data relating to officer-issued offences, then please proceed with the request on that basis.
Response:
Section 1 of the Freedom of Information Act 2000 places two duties on public authorities. Unless exemptions apply, the first duty at Section 1(1) (a) is to confirm or deny whether the information specified in a request is held. The second duty at Section 1(1) (b) is to disclose information that has been confirmed as being held.
Where exemptions are relied upon Section 17 of the Freedom of Information Act 2000 requires Dyfed Powys Police, when refusing to provide such information (because the information is exempt) to provide you the applicant with a notice which: (a) states that fact, (b) specifies the exemption in question and (c) states (if that would not otherwise be apparent) why the exemption applies.
I can confirm that Dyfed-Powys Police does hold the information you have requested. However we are withholding the whole of the requested information since we consider that the Section 12(1) exemption the Cost of Compliance exceeds the Appropriate Limit applies to it.
Section 12 (1) – The cost of compliance exceeds the Appropriate Limit
Section 12(1) states: “…Section 1 (1) does not oblige a public authority to comply with a request for information if the authority estimates that the cost of complying with the request would exceed the appropriate limit.”
The cost of providing you with the information requested in respect of your request is above the amount to which we are legally required to respond i.e. the cost of locating and retrieving the information exceeds the “appropriate level” as stated in the Freedom of Information (Fees and Appropriate Limit) Regulations 2004. It is estimated that it would exceed 18 hours (i.e. minimum of 1,934.84 hours) to comply with this part of your request. The Freedom of Information department has been advised that the information in respect of questions 1 – 7 of your request for individuals stopped by a police officer is not held in an easily retrievable format. In light of this and in order to accurately obtain the information relative to your request for the time frame stipulated would involve Dyfed Powys Police accessing and reviewing all Traffic Offence Reports (TORs) to identify the responses to questions 1 – 7 of your request. It has been established that there are a total of 11,609 TORs that cover the period of your request. It has also been established that it would take a minimum of 10 minutes to review and obtain the information for questions 1 – 7 for a single TOR in respect of your request (as outlined above). The process outlined results in the below time estimate.
2023 = 646 TORs at a minimum of 10 minutes per TOR = 107.67 hours
2024 = 2,220 TORs at a minimum of 10 minutes per TOR = 370.00 hours
2025 = 7,420 TORs at a minimum of 10 minutes per TOR = 1,236.67 hours
01/01/26 – 31/03/26 = 1,323 TORs at a minimum of 10 minutes per TOR = 220.50 hours
Time estimate to complete task = 1,934.84 hours
Please note: The above response relates only to instances in which an individual has been stopped by a Police Officer and a Traffic Offence Reported submitted. Information relating to speeding offences via mobile camera vans and static cameras would be held by the Safety Camera Unit.

In accordance therefore with the Freedom of Information Act 2000, this letter acts as a Refusal Notice for the Whole of this request under Section 17(5) A public authority which, in relation to any request for information, is relying on a claim that section 12 or section 14 applies must, within the time for complying with section 1(1), give the applicant a notice stating that fact.
You may wish to refine and resubmit your request so that it reduces the time shown above to fall within the 18 hours, however with due regard to the time estimate provided above it is unlikely that refining your request will fall under the 18 hours as the same method and format will have to be undertaken. Should you require any further advice in relation to this matter please don’t hesitate to contact the Freedom of Information Unit. Please also be advised that should the request be refined, it does not remove the public authorities right to cite exemptions if relevant.
